2. Service Description

CustomerNearMe is a business prospecting and lead organization platform. Depending on your plan and available features, the service may provide:

• Business discovery using available data sources.
• Saving and organizing business prospects.
• Lead pipeline and activity management.
• CSV exports and bulk actions.
• Follow-up reminders.
• Website contact enrichment.
• SEO estimates and related business information.
• Account and subscription management.

Features, usage limits, availability, and pricing may vary by plan. The features and limits displayed at the time of purchase apply to your subscription, subject to these Terms and any clearly disclosed plan conditions.

CustomerNearMe does not guarantee that every business record, contact detail, website, or estimate will be accurate, complete, available, or current.

3. Accounts and Security

You must be legally permitted to enter into a binding agreement to use CustomerNearMe.

When creating an account, you agree to provide accurate information and keep it reasonably up to date.

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• Protecting access to your account and connected devices.
• Using the service only through authorized access methods.
• Notifying us promptly if you suspect unauthorized access.
• Activities performed through your account, except where applicable law provides otherwise.

You must not impersonate another person, create accounts through deceptive means, or use the service to circumvent account or subscription restrictions.

4. Subscriptions and Billing

4.1 Paid plans

Certain features require a paid subscription. Current plans, prices, usage limits, and included features are displayed on our website or at checkout.

4.2 Payment processing

CustomerNearMe uses Paddle for subscription payment processing. When you purchase a subscription, your transaction is subject to Paddle’s applicable checkout terms, payment conditions, and privacy policy. Paddle may process payment information and provide CustomerNearMe with transaction or subscription information needed to activate and manage your plan.

4.3 Automatic renewal

If your selected subscription renews automatically, you authorize recurring charges at the price and billing interval disclosed during checkout until you cancel, subject to the applicable subscription terms.

4.4 Cancellations

You may cancel a subscription using the cancellation method made available for your purchase or by contacting the designated support channel. Cancellation timing, continued access, and any remaining billing obligations depend on the terms disclosed at purchase and applicable law.

4.5 Refunds

Refund eligibility is governed by our Refund Policy, any applicable Paddle terms, and mandatory consumer-protection laws. Nothing in these Terms excludes a refund or other right that cannot legally be excluded.

4.6 Free trials and promotions

If we offer a free trial, giveaway, promotional subscription, or discount, the specific eligibility conditions, duration, feature limits, and expiry rules will be disclosed with that offer. Promotional access may expire at the end of the stated period. Any conversion to a paid subscription must follow the conditions disclosed when the user signs up.

5. Acceptable Use

You agree to use CustomerNearMe lawfully and in accordance with these Terms. You must not:

• Use the service to violate applicable laws or regulations.
• Use prospect information for unlawful, deceptive, harassing, or fraudulent purposes.
• Send unlawful or unsolicited communications in violation of applicable marketing or privacy laws.
• Circumvent technical safeguards, account limits, or subscription restrictions.
• Attempt unauthorized access to our systems, databases, or other users’ accounts.
• Introduce malware or interfere with the security or operation of the service.
• Reverse engineer or copy protected parts of the service except where applicable law permits it.
• Resell, redistribute, or commercially exploit access to the service in a way prohibited by your plan or applicable third-party terms.
• Scrape, harvest, or collect information from third-party services in violation of their applicable terms or technical restrictions.
• Misrepresent your identity or the source of information obtained through the platform.

We may investigate suspected violations and take proportionate action, including restricting access or suspending an account when reasonably necessary and permitted by law.

6. Business Data and User Content

CustomerNearMe may use or display information supplied by third-party business data, mapping, search, or website-enrichment services. Such information may be incomplete, outdated, duplicated, or inaccurate. Availability may change if a third-party provider changes its service, access rules, or data.

Your use of third-party data must comply with applicable laws and any relevant source-provider terms. You are responsible for determining whether your intended use of the information is lawful.

You retain the rights you have in content and information you submit to CustomerNearMe, subject to any rights belonging to third parties. You grant us permission to host, process, transmit, and display that content as reasonably necessary to operate and provide the service to you.

You confirm that you have the necessary rights and lawful basis to submit information you upload or store. You are responsible for the notes, imported data, saved prospects, and other content you add to your account. Do not upload information unlawfully or information you are not authorized to use.

7. Service Availability and Liability

We aim to maintain a useful and reliable service, but we do not guarantee uninterrupted access, error-free operation, or continuous availability of every feature. We may update, repair, modify, or discontinue features when reasonably necessary, including for security, technical, legal, or operational reasons.

To the maximum extent permitted by applicable law, CustomerNearMe is provided on an “as available” basis. We do not warrant that the service will meet every user’s specific requirements or that business data, contact information, lead results, or SEO estimates will be complete, accurate, current, or suitable for a particular outcome.

You are responsible for independently verifying important information and deciding how to use it.

To the maximum extent permitted by applicable law, the service operator will not be liable for indirect, incidental, special, consequential, or punitive losses, or loss of profits, revenue, business opportunities, or data arising from the use of the service.

8. Termination and Contact

You may stop using CustomerNearMe at any time. If you have a paid subscription, stopping use of the service does not necessarily cancel the subscription; follow the applicable cancellation procedure.

We may suspend or terminate access where reasonably necessary if you materially violate these Terms, create a security risk, engage in unlawful activity, fail to meet applicable payment obligations, or where continued access would create a legal or operational risk.

Upon termination, your right to use the affected service ends. Handling of outstanding payments, saved information, and deletion requests remains subject to the applicable subscription terms, our Privacy Policy, and relevant law.
